These terms, and what they cover

These Terms of Use govern your access to and use of this website. By using the site, you accept them. If you do not accept them, please do not use the site.

These terms cover the website only. They do not govern any project we carry out for you.

If you engage AgileTech Vietnam to build software, that work is governed by a separate signed agreement, and where anything in these terms conflicts with that agreement, the signed agreement wins. See client engagements are governed separately.

Who you are dealing with

This site is operated by AgileTech Vietnam, a software development company with its head office and delivery centre in Hanoi, Vietnam, and a presence in Irvine, California. Contact details are at the end of these terms.

How you may use this site

You may browse this site, and you may print or download extracts for your own internal, non-commercial evaluation of whether to work with us. When you do, please keep any copyright and other proprietary notices intact.

You may link to any page on this site, provided the link is fair, does not damage our reputation, and does not suggest an association, endorsement, or approval that does not exist. Do not frame this site inside another site.

What you may not do

You agree not to:

• Use the site for any unlawful purpose, or in breach of any applicable law or regulation.
• Copy, republish, sell, licence, or commercially exploit any part of the site without our written permission.
• Systematically extract content by scraping, crawling, or automated means beyond what a search engine ordinarily does, or use the content to train a machine learning model without our written permission.
• Attempt to gain unauthorised access to the site, its server, or any connected system, or probe, scan, or test its security without our written permission.
• Introduce malware, or attack the site by denial of service or any similar means.
• Submit false, misleading, or fraudulent information through the contact form, or use it to send unsolicited advertising, spam, or abusive content.
• Impersonate any person, or misrepresent your affiliation with any person or organisation.
• Interfere with anyone else's use of the site.

We may suspend or block access where we reasonably believe any of the above is happening. Serious breaches may be reported to the relevant authorities.

If you are a security researcher and you believe you have found a vulnerability, we would rather hear from you than not. Please see our Security page for how to report it responsibly.

Intellectual property

Unless stated otherwise, all content on this site, including text, page structure, design, graphics, icons, illustrations, photographs, and source code, is owned by AgileTech Vietnam or used with permission, and is protected by copyright and other intellectual property laws.

The AgileTech Vietnam name and logo are our marks. You may not use them without our written permission, except to refer to us accurately and fairly.

Third-party names, logos, and product marks appearing on this site, including the technology and platform logos shown on our services and technologies pages, belong to their respective owners. They are shown to describe the technologies we work with. Their appearance does not imply that we are endorsed by, affiliated with, or acting as an agent of those owners, except where we say so explicitly.

Case studies, client names, and testimonials are published with the permission of the parties concerned, or are drawn from public review platforms and attributed to their source.

Enquiries and material you send us

When you send us an enquiry, you confirm that the information you provide is accurate, that you are entitled to provide it, and that doing so does not breach anyone else's rights.

Please do not send confidential information through the contact form.

Use it to tell us enough that we can respond sensibly. If your project needs a detailed disclosure, ask us for a non-disclosure agreement first and we will put one in place. We are glad to sign one. Material you send us before an NDA exists is received on a non-confidential basis, and we cannot treat it as confidential when no confidentiality obligation had yet been agreed.

If you send us an unsolicited idea, suggestion, or feedback about our website or services, you grant us a non-exclusive, royalty-free, worldwide licence to use it to improve what we do. This does not apply to your project information or to anything covered by an NDA or a signed engagement.

What we do with the personal data in your enquiry is set out in the Privacy Policy.

No professional advice, and no offer

The content on this site is published for general information. It describes our capabilities and our approach. It is not technical, legal, regulatory, financial, or compliance advice, and you should not act on it without advice specific to your circumstances.

Nothing on this site is an offer capable of acceptance. Descriptions of services, engagement models, and delivery approaches are indicative. A binding commitment arises only when we and you sign a written agreement. Any timelines, team compositions, or outcomes described are illustrative of how we work rather than a promise about your project.

Statistics, certifications, and ratings shown on this site are accurate as at the date published. Ratings from third-party platforms reflect those platforms at the time we cited them and may change.

Third-party links and marks

This site links to third-party websites, including review platforms and our social media profiles. We do not control those sites and are not responsible for their content, their accuracy, or their privacy practices. A link is not an endorsement. Once you follow one, their terms apply.

Availability of the site

We aim to keep the site available, but we do not guarantee that it will be available uninterrupted or error-free. We may suspend, withdraw, or restrict all or part of it for business or operational reasons, including maintenance, and we will try to give reasonable notice where we can.

You are responsible for arranging your own access to the site and for ensuring that everyone accessing it through your connection is aware of these terms.

Disclaimers

The site and its content are provided "as is" and "as available". To the fullest extent permitted by law, we exclude all conditions, warranties, and representations that might otherwise be implied, including as to accuracy, completeness, currency, fitness for a particular purpose, and non-infringement.

We take care over the content of this site, but we do not warrant that it is complete, current, or free of errors. Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

Limitation of liability

To the fullest extent permitted by law, AgileTech Vietnam will not be liable to you for any loss of profit, loss of revenue, loss of business, loss of anticipated savings, loss of goodwill, loss or corruption of data, or any indirect or consequential loss, arising out of or in connection with your use of, or inability to use, this website.

Where liability arising from your use of this website cannot lawfully be excluded, our total aggregate liability is limited to one hundred United States dollars (USD 100).

This section concerns the website only. Liability under a client engagement is dealt with in the signed agreement for that engagement, and is not limited by this paragraph.

Indemnity

You agree to indemnify us against any claim, loss, or expense arising from your breach of these terms, your misuse of the site, or your violation of any law or third-party right through your use of the site.

Client engagements are governed separately

This is worth repeating because it is the point most often misread on a page like this.

If you become a client, the work is governed by a signed master services agreement, statement of work, or equivalent, together with a data processing agreement where personal data is involved. Those documents deal with scope, acceptance, fees, intellectual property ownership in the deliverables, warranties, confidentiality, liability, and termination.

These Terms of Use do not vary those documents, and where the two conflict, the signed agreement prevails. Nothing on this website reduces any right you have under a contract with us.

Privacy

Our handling of personal data is described in the Privacy Policy, and our position on cookies and tracking is described in the Cookie Policy. Both form part of your use of this site.

Changes to these terms

We may revise these terms. The version published here is the version that applies to your use of the site, and the date at the top tells you when it last changed. Please check it from time to time.

Governing law and disputes

These Terms of Use, and any dispute arising out of or in connection with them or with your use of this website, are governed by the laws of Vietnam. The courts of Vietnam have exclusive jurisdiction, except that we may bring proceedings to protect our intellectual property in any competent jurisdiction.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law grants you mandatory protections, nothing in this section deprives you of the protection of those mandatory rules or of the right to bring proceedings in your place of residence.

Before starting formal proceedings, please contact us. Most issues are resolved faster by a conversation.

General

• If any provision of these terms is held unenforceable, the rest continues in force.
• If we do not enforce a right immediately, that is not a waiver of it.
• You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours as part of a reorganisation or business transfer, provided your rights are not reduced.
• A person who is not a party to these terms has no right to enforce them.
• These terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between us in relation to your use of this website.
